Ruling issued on motion to remove chief judge from Baby Kate father's murder case
The prosecutors have appealed Wadel’s April 6 refusal to disqualify himself as trial judge. Spaniola and Assistant Attorney General Donna Pendergast are seeking his removal because Wadel, sitting as a district judge at an earlier stage of the process, ruled that prosecutors had not established probable cause that Phillips committed murder.
